    General Terms and Conditions (GTC)

Rent a Nanny-Mallorca is a childcare agency for any emergency as well as for all types of childcare requests. Our agency is also happy to assist in finding suitable solutions for long-term care.

Our general terms and conditions apply to the use of the following services:

1. Booking of hourly childcare/emergency childcare.

2. Professional Nanny Placement

3. Recruitment of qualified nannies for full-time or part-time employment by the client

Rent a Nanny-Mallorca is not a physical childcare facility (such as a daycare centre) and does not provide daycare services.

The following general terms and conditions apply to all business relationships between the client and the agency Rent a Nanny-Mallorca, Carrer Platja 1, 07560 Son Moro, St. LLorenc de Cardassar, represented by the owner Astrid Flamer (hereinafter also referred to as the agency or Rent a Nanny-Mallorca).

The version of these general terms and conditions valid at the time of the conclusion of the contract is authoritative. 

1.Booking of hourly childcare/Emergency care:

⚠️ Note: Our direct service for hourly childcare is available exclusively within the immediate vicinity of our location in Cala Millor on the East Coast. However, thanks to our excellent network of experienced self-employed nannies, we offer island-wide placements and are happy to assist you in finding the right childcare provider.

 

Minimum booking: 3 hours

Unless otherwise agreed, the current agency prices apply to the hourly booking of our childcare service. The current prices can be viewed on our website at www.rentananny-mallorca.com/en/preise

The prices include the statutory VAT and apply for 1 child.

Child surcharge: EUR 5.00 / per hour, per additional child. Maximum 3 children per nanny.

Depending on the activity and number of children, the hourly rate may increase. 

Billing is based on the actual time spent and is to be settled in cash with the nanny directly after the assignment.

Travel costs will be charged individually, according to expenditure.

If the booking time is exceeded, we charge a surcharge of EUR 7.50 / per quarter of an hour or part thereof. This does not apply if the time overrun is due to misconduct on the part of the caregiver.

For the processing effort required in connection with the reservation, we charge a service fee of EUR 29.00 per booking. 

Please settle the amount at the time of booking using one of the following payment methods. The booking only becomes binding once we have received the payment.

All transaction fees – particularly for currency conversions or payments from outside the EU – shall be borne by the client.

 

The service fee is to be paid regardless of whether the service is used. In the event of non-use of the booked service, the client is not precluded from proving that the contractor has not incurred any damage or that it is substantially lower than the fee to be paid hereafter.

Emergency surcharge: For bookings made within 3 days before the desired childcare period, a flat-rate rush fee of EUR 35.00 will be added.

For rebookings, we charge a processing fee of EUR 15.00.

Free cancellation (in writing, by e-mail) possible within 24 hours of booking. 

If the cancellation is made 48 - 24 hours before the booked childcare date, 50 % of the booking amount will be charged.
If the cancellation is made between 24 and 0 hours before the booked childcare appointment, 100 % of the booking amount will be charged.

If an appointment is not kept without prior cancellation, the client will be charged 100%. In the event of cancellation fees being incurred, the client will receive an invoice. The amount stated therein is to be paid within a maximum period of 14 days to the account stated in the invoice.

 

If, due to unforeseen, unavoidable reasons (force majeure, accident, illness, and other serious reasons), the contractor is unable to fulfill the assignment, the contractor waives the agreed costs at the request of the client. The contractor must inform the client immediately and, at the client's request, provide an alternative appointment. Claims for damages against the contractor are excluded.

2. Placement of Professional Nannies for Hourly, Short-Term Assignments

If Rent a Nanny-Mallorca cannot immediately suggest a suitable nanny for the desired time or location, we offer customized search and placement services upon request.

The agency exclusively places qualified, experienced professionals for short-term assignments who can prove their legal status as self-employed nannies on Mallorca. Rent a Nanny-Mallorca explicitly distances itself from the facilitation of undeclared employment.

All nannies placed for hourly assignments are registered as self-employed service providers, manage their engagements independently, and set their own rates – especially during holiday periods, availability may be limited. The agency has no influence over this.

 

Service Fee (Placement Request Fee)

To commission our services, a non-refundable flat service fee is due, which is determined based on the complexity and individual workload of the request.

This fee covers all activities by Rent a Nanny-Mallorca related to the intake and processing of client information, including:

  • Collection and preparation of customer data

  • Internal documentation

  • Organizational steps to arrange placements and communicate with potential caregivers

Once the service fee is received, the assignment is considered confirmed and we will begin the placement process immediately.

This fee is due regardless of whether the arranged service is ultimately used. If the client withdraws after paying the fee, this does not release them from payment obligations if Rent a Nanny-Mallorca has already partially or fully performed the agreed services. The client may provide proof that no or significantly lower damage has occurred to the agency.

 

Placement Process

Once we have received all relevant information about your childcare needs, we will create a requirements profile and immediately contact suitable candidates from our network. We confirm their availability and inform the client as soon as we can present a shortlist (including qualifications, experience, and availability).

 

Placement Fee

In addition to the flat service fee, a placement fee of 10% of the projected total gross wage for the assignment is due upon successful placement of a nanny proposed by Rent a Nanny. This is calculated as the total planned hours multiplied by the hourly rate indicated by the caregiver.

We will provide an exact cost breakdown as soon as the scope of care is determined and estimated wage costs can be calculated.

Important: The placement fee is due immediately upon acceptance of the proposed candidate and must be paid before contact details are released. After receipt of payment, the client will receive full contact information and application documents of the proposed nanny.

 

Urgency Surcharge

For requests received less than 72 hours before the desired start of care, a one-time urgency surcharge of EUR 35.00 will apply. This must be paid in addition to the standard placement fee.

 

Independence of Caregivers

The caregivers set their own rates, operate in their own name, and on their own account. All agreements about the nature of the service are made directly between the caregiver and the client.

 

3. Recruitment of Qualified Childcare Staff for Permanent Employment (Full-time or Part-time)

Based on the client’s requirements, Rent a Nanny-Mallorca recruits individually matched candidates for long-term employment.

The cost of placement is calculated based on the gross annual salary of the position. For regular employment relationships, the placement fee is 10% of the projected gross annual salary.

For placements lasting under six months or with fewer than 25 weekly hours, Rent a Nanny-Mallorca reserves the right to determine a customized placement fee based on the actual recruitment effort. This will be clearly communicated before the collaboration begins.

 

Recruitment Process & Fee Structure

The recruitment is based on a three-stage fee model. The fee is payable in the following stages:

1. Service Fee (Base Fee)Due at Order Placement
A non-refundable base fee is charged to initiate the recruitment process. It covers the creation of a requirements profile, publishing job ads, proactively contacting potential candidates, pre-screening applications, and administrative work.

2. Shortlist FeeDue upon Candidate Presentation
As soon as Rent a Nanny-Mallorca presents a carefully selected shortlist of candidates, the shortlist fee becomes due. This obligation arises from these terms and is accepted by placing an order. There is no entitlement to a refund once suitable candidates have been presented – even if no employment contract is ultimately concluded. Clients can provide proof if no or lesser damage was caused.

3. Final FeeDue upon Signing the Employment Contract
The final payment becomes due upon signing an employment contract with a candidate proposed by the agency. The amount is calculated based on the agreed gross annual salary and must be paid no later than the first day of employment.

Contractual Relationship & Legal Notices

The client enters a direct employment relationship with the caregiver and agrees to comply with Spanish labor laws – especially regarding minimum wage and social security.

Rent a Nanny-Mallorca offers support with contract drafting upon request for an additional fee and expressly disassociates itself from any form of undeclared work.

A copy of the signed employment contract must be sent to the agency to document the placement success. It will be treated confidentially.

Candidates are proposed by Rent a Nanny-Mallorca. The agency assumes no responsibility or liability for outcomes resulting from the recommendation or for any actions or omissions of the client and/or the caregiver.

General Provisions

Confidentiality & Data Protection

All information provided by Rent a Nanny-Mallorca (e.g., documents, contact details) about proposed candidates is to be treated as confidential and intended solely for the client. Disclosure to third parties is only permitted with express consent from the agency or the individual concerned.

By entering into a contract, the client confirms that they have read the privacy policy.

Supervisory Duty

During childcare hours, the legal guardians temporarily transfer supervision duties to the caregiver within the legal framework. The caregiver is responsible for safeguarding the child’s well-being and preventing harm to or caused by the child.

 

Liability Disclaimer

Rent a Nanny-Mallorca’s services in search, assessment, and placement do not replace the client's own due diligence. The agency accepts no liability for the conduct or suitability of proposed candidates. All claims arising from the employment relationship are the responsibility of the client.

Rent a Nanny-Mallorca is only liable for intent or gross negligence within legal limits. The nanny is personally liable for any damages arising in connection with their services.

Force Majeure

If the service provider is unable to fulfill the assignment due to unforeseen, unavoidable circumstances (force majeure, accident, illness, or other serious reasons), they waive the agreed costs upon request. They must inform the client immediately and offer an alternative date if desired. Claims for damages against the service provider are excluded.

Final Provisions

The client agrees to provide truthful, complete, and up-to-date information. Changes must be communicated in writing without delay.

The agency reserves the right to amend these terms and other website content at any time without prior notice. The version valid at the time of service usage applies.

If any provision of these terms is held to be invalid, the remaining provisions shall remain in full force and effect.

Place of jurisdiction is the competent court at the agency’s business location in Spain, unless otherwise stipulated by law.

As a customer, you have the right to revoke this contract within 14 days without giving any reason. The revocation period is fourteen days from the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form*, but this is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of the revocation:

If you withdraw from this contract, we must refund all payments we have received from you immediately and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

 

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

Special information on the early expiry of the right of withdrawal: Your right of withdrawal will expire early if we have provided the service in full and have only started to provide the service after you have given your express consent to this and at the same time you have confirmed your knowledge that you will lose your right of withdrawal upon full performance of the contract.
